We are a group of talented and experienced trial lawyers committed to achieving justice for our whistleblower clients by using our backgrounds as Department of Justice attorneys and Centers for Medicare and Medicaid Services lawyers to benefit our clients. Under the leadership of firm founder Barry Cohen, we combine our prior experiences as federal prosecutors who investigated and tried criminal health care fraud cases, Assistant United States Attorneys who investigated and settled False Claims Act cases, white collar lawyers who defended health care and defense procurement fraud investigations, and a CMS lawyer who advised the Department of Justice on qui tam cases to maximize our clients’ opportunities for success.

Kevin Darken
Qui tam team leader Kevin Darken has spent most of the past five years of his 23 year career bringing and litigating qui tam cases. Mr. Darken has substantial expertise in both health care fraud and defense procurement fraud and is the author of a treatise on health care fraud law. He has been named to Best Lawyers in America by his peers.

As an Assistant U.S. Attorney in the 1990s, Kevin Darken investigated and prosecuted criminal health care fraud cases, served as Health Care Fraud Coordinator for the Middle District of Florida, and served on the Department of Justice’s National Health Care Fraud Working Group. He received the Integrity Award from the Office of Inspector General for the United States Department of Health and Human Services for his “outstanding leadership in the fight against health care fraud.” Mr. Darken also was instrumental in several global settlements which resolved concurrent civil and criminal health care fraud investigations.

Between leaving the Department of Justice and becoming a qui tam relator’s lawyer, Kevin Darken was a white-collar defense attorney representing doctors, hospitals, and other health care providers in criminal health care fraud investigations. He won a three-week Medicare fraud trial for the former CEO of a peer review organization. Mr. Darken also represented the nation’s largest ambulance company and Florida’s largest insurer in successfully resolving False Claims Act cases.

In addition to his book, which is currently in its 10th edition, Mr. Darken has published 6 articles and given 22 speeches on health care fraud and False Claims Act litigation. He even testified at a trial in Michigan as an expert witness in health care fraud law.

Prior to joining the Department of Justice, Mr. Darken defended defense procurement fraud and other government contract fraud investigations for five years as an attorney with the Crowell & Moring law firm in Washington, D.C. for such clients as General Electric and United Techologies Corporation in investigations in Florida, Massachusetts, Connecticut, Minnesota, and California.

Kevin Darken graduated from Harvard Law School in 1986 and from Yale University in 1982. He is AV rated by Martindale-Hubbell.

Barry A. Cohen
Master trial lawyer Barry Cohen supervises the firm’s qui tam team. He has been involved in qui tam litigation for over a decade when he sued HealthSouth Corp. under the False Claims Act. Mr. Cohen has been included in Best Lawyers in America for both civil and criminal litigation for over 25 years. He graduated from Mercer University Law School in 1966 and Florida State University in 1962.
