Premises Liability
Florida law imposes a duty on property owners and lessors to maintain their property in a reasonably safe condition. Property owners or lessors can be held responsible for certain injuries or deaths on their property, even if caused by intentional criminal conduct. More than just slip and fall cases, premises liability issues can also include the failure to provide reasonable security in apartment complexes, shopping centers, restaurants, bars, parking lots and garages. Cohen, Jayson & Foster has filed suit against numerous property owners for a variety of injuries, ranging from sexual assault to fatal shootings.
Product Liability
Under product liability law, the manufacturer or seller of a defective product may be responsible for an injury that results to a buyer, user or, in certain cases, an innocent bystander. Under Florida law, product liability cases may involve manufacturing defects, design defects, or the failure to warn of known hazardous conditions. Those injured as the result of a defective product may have the right to compensation for their injuries.
